Waste Management Regulations for NYC Businesses: Secure Lids Required



On March 1, 2024, New York City implemented a crucial new regulation that impacted all businesses setting out waste for collection on the curb. Going forward, every business in NYC must utilize bins equipped with secure lids when disposing of their trash. This ongoing initiative is aimed at bolstering cleanliness throughout the five boroughs and reducing the number of trash bags lining the city's streets, a goal shared by the team here at Cogent Waste Solutions.


Proper Waste Separation and Setout Procedures

These new rules apply to all businesses that set out their waste at the curb; however, businesses that have their waste collected from a loading dock are exempt from this requirement.


When preparing waste for collection, it is imperative that all trash, food, and food-soiled paper be placed within a bin that has a secure lid. Additionally, businesses are required to have an adequate number of bins to contain the waste generated over a 72-hour period. Non-compliance with these regulations could result in fines.


It’s worth noting that this new regulation does not extend to recyclables such as metal, glass, plastic, or clean paper and cardboard, which can be managed separately. Furthermore, while the regulation does not necessitate the separation of trash from food or food-soiled paper, it does mandate that these materials be stored in bins with secure lids.


Setout Times for Business Waste

Businesses must strategically place their bins with secure lids at the curb either one hour before closing or after 8:00 PM. Though not mandatory, bins can also be used for recycling purposes, with recycling bags or bundles allowed to be set out after 8:00 PM.


Important to note is the requirement that bins be promptly removed from the curb by the time business reopens. For those utilizing metal dumpsters, there are specific stipulations, including immediate removal post-collection and maintenance of cleanliness around these containers.


Storage and Maintenance of Bins

When not in use for collection, bins should ideally be stored in a rear yard or indoors. In cases where space is limited, they may be kept within three feet of the building line. All bins, including dumpsters, must be covered at all times with securely-fitting lids.

Finally, it’s essential that storage areas remain neat and orderly, ensuring pedestrian pathways on sidewalks are clear and unobstructed. Enclosures positioned on sidewalks are subject to Department of Transportation regulations, further underscoring the need for compliance.
